Community update on the proposed Waste Transfer Station in Hampton Park

Advocacy efforts since November 2024

Since the election in November 2024, the Mayor and Councillors have been actively advocating on behalf of the community regarding concerns about a proposed Waste Transfer Station in Hampton Park. This includes making multiple submissions and representations to the Environmental Protection Authority (EPA) and Victorian Government; and supporting a Notice of Motion in March 2025 led by Cr Lynette Pereira to advocate on behalf of the Hampton Park community.

EPA decision

In April 2025, the EPA refused a Development Licence application by Veolia. The EPA determined that the proposed waste transfer station posed unacceptable risks to human health and the environment, primarily from odour and noise emissions due to its close proximity to residential homes. Council acknowledges the significant community interest in this proposal.

Council's role and obligations

In October 2024, prior to the return of Councillors, Council approved a Planning Permit for the Waste Transfer Station as part of its statutory role as the Responsible Planning Authority. This role involves assessing planning applications based on relevant planning laws. Council is also a member of the South Eastern Metropolitan Advanced Waste Processing (SEMAWP) group of nine councils who, in July 2024, signed a Waste Supply Agreement with the Maryvale Energy from Waste facility.

Next steps and legal proceedings

The EPA has advised Council that Veolia has appealed the decision at the Victorian Civil and Administrative Tribunal (VCAT). A hearing is scheduled for 11, 12, 14 and 15 August 2025. Council’s statutory role as the Responsible Planning Authority limits its influence over the VCAT hearing process.

Due to Council’s dual roles and obligations as the Responsible Planning Authority and a member of SEMAWP, Council will not be taking any further action while the EPA VCAT review is occurring.

If VCAT upholds the EPA’s refusal of the Development Licence, the Planning Permit will be redundant, and the waste transfer station cannot be constructed.
