The Planning Scheme and Planning & Environment Act 1987 give Council officers the power to investigate and prosecute matters, and Council is required by law to enforce a Planning Scheme.
Enforcement action will be taken when there is a clear breach of the Planning regulations, planning permit conditions, unauthorised developments and illegal uses.
Council prefers to negotiate with alleged offenders to gain compliance rather than seeking prosecution, however if negotiation fails a number of options are available to the Responsible Authority.
